Court Adjourns ADC Leadership Crisis Suit Indefinitely Amid Fresh Legal Drama

The Federal High Court in Abuja has indefinitely postponed proceedings in the ongoing legal battle challenging the leadership structure of the African Democratic Congress (ADC).

The case was filed by ADC chieftain Nafiu Bala Gombe, who is contesting the emergence of former Senate President David Mark and former Osun State governor Rauf Aregbesola in the party’s leadership arrangement.

Justice Emeka Nwite adjourned the matter indefinitely after the plaintiff informed the court that an application had been submitted to the Chief Judge of the Federal High Court requesting the transfer of the case to another judge.

Fresh Twist in ADC Leadership Dispute

During proceedings, counsel to the plaintiff, Luka Musa Haruna, informed the court that the Supreme Court had earlier dismissed an interlocutory appeal filed by David Mark against the case.

According to him, the apex court also overturned the Court of Appeal’s earlier order which had temporarily halted proceedings in the substantive suit.

Haruna, however, disclosed that the plaintiff had formally written to the Chief Judge seeking reassignment of the case, urging Justice Nwite to suspend further action pending an administrative decision.

Defence Lawyers Oppose Request

Lawyers representing the defendants strongly opposed the move, accusing the plaintiff of attempting to delay the accelerated hearing previously ordered by higher courts.

Counsel to the first defendant described the request as an “ambush,” arguing that the defence had not been officially served with the application.

Another defence lawyer alleged that the move amounted to “forum shopping” and an attempt to influence judicial proceedings.

The legal team further argued that allowing such a request without proper procedure could set a dangerous precedent within the judiciary.

Court Explains Reason for Indefinite Adjournment

In his ruling, Justice Nwite stated that the court could not act on a letter addressed to the Chief Judge without hearing all parties involved in the matter.

The judge explained that taking any decision on the request without input from the defendants could violate their constitutional right to fair hearing.

He subsequently adjourned the case indefinitely to allow:

  • Proper filing of the Supreme Court judgment
  • Service of the transfer request on all parties
  • Possible further directives from the Chief Judge

The lawsuit has intensified internal tensions within the ADC ahead of future political realignments and the 2027 elections.

Nafiu Bala Gombe is seeking a court order restraining David Mark, Rauf Aregbesola and others from presenting themselves as leaders of the party.

He argues that their appointments allegedly violate the ADC constitution and provisions of Nigeria’s Electoral Act.
